Insurance companies are the ultimate backstop for whether a decision by an insured was reasonable, in good faith or prudent, regardless of if that decision came from a new entity, an existing entity, a trustee or other fiduciary or an HOA, the insurance company usually is the party defending against claims and therefore the most likely party to benefit from a DR reasoned recommendation. DR reasoned recommendations are issues with respect to a decision before action is taken to provide an independent perspective as to whether a decision is perceived to be reasonable, in good faith or prudent. Seeking a recommendation, in advance, from DR, may mitigate insurance claims and future litigation.
